These Terms of Service apply to the use of the SafeFlame website and to purchases made from SafeFlame, operated by Linfield Pacific Pty Ltd.

By accessing this website, placing an order or purchasing our products, you agree to these Terms of Service. These terms should be read together with our Return and Refund Policy, Privacy Policy and any other policies displayed on this website.

1. About SafeFlame

SafeFlame supplies reusable battery-operated LED candles and related products for Christmas Carols, church services, school events, council events, commemorations and other community activities.

In these terms, “SafeFlame”, “we”, “us” and “our” refer to Linfield Pacific Pty Ltd. “Customer”, “you” and “your” refer to the person or organisation accessing the website or purchasing our products.

2. Website Use

You may use this website only for lawful purposes.

You must not:

  • Use the website for fraudulent, unlawful or misleading purposes

  • Attempt to interfere with the operation or security of the website

  • Introduce malicious code, viruses or other harmful material

  • Copy or commercially exploit website content without permission

  • Submit false contact, payment, delivery or organisational information

We may restrict or terminate access where we reasonably believe these terms have been breached.

3. Product Information

We take reasonable care to ensure that product descriptions, specifications, photographs, pricing and availability information are accurate.

Colours and appearance may vary slightly because of lighting, photography, screen settings and normal manufacturing tolerances. Minor variations that do not materially affect the product’s function or agreed design are not necessarily defects.

All product specifications, prices and availability may be updated from time to time. Changes will not affect an order already accepted unless agreed with the customer or required by law.

4. Pricing and GST

Unless stated otherwise, prices displayed on the Australian SafeFlame website are in Australian dollars and include GST.

Shipping, custom printing, setup charges and other applicable costs are shown separately before an order is completed or in a written quotation.

We may correct genuine pricing or typographical errors. If an error affects an order already placed, we will contact the customer before proceeding and offer the opportunity to confirm or cancel the affected order.

5. Minimum Order Requirements

Unless otherwise agreed in writing:

  • The minimum total candle order is 100 candles

  • Each candle style must be ordered in multiples of 25

  • Different eligible candle styles may be combined to reach the minimum total quantity

Orders that do not meet these requirements may be rejected, cancelled or adjusted after consultation with the customer.

6. Orders and Acceptance

Submitting an order does not guarantee acceptance.

An order is accepted when we issue an order confirmation or invoice, accept payment, or commence fulfilment or custom production.

We may decline or cancel an order before acceptance where:

  • Products are unavailable

  • Payment cannot be authorised

  • The order contains an obvious pricing or product-information error

  • Delivery cannot reasonably be completed

  • The order appears fraudulent or unlawful

  • Minimum-order requirements have not been met

If we cancel an order after receiving payment, we will refund the affected amount to the original payment method.

Customers are responsible for checking product selection, quantities, contact details, delivery address, event date and custom-printing information before submitting an order.

7. Product Availability and Pre-Orders

Product availability shown on the website may include stock available for pre-order or expected future delivery.

Any production, arrival or dispatch date provided for a pre-order is an estimate unless we expressly confirm a guaranteed date in writing.

If an estimated date changes materially, we will contact affected customers and explain the available options. Nothing in this section limits rights available under the Australian Consumer Law.

8. Event Dates and Delivery Planning

Customers purchasing products for a particular event should provide the correct event date and order with an appropriate delivery margin.

Delivery and dispatch estimates are not guaranteed event-delivery commitments unless SafeFlame expressly agrees to a specific deadline in writing.

Customers remain responsible for allowing sufficient time for:

  • Product availability

  • Order processing

  • Custom artwork approval

  • Printing or production

  • Carrier delivery

  • Possible delays to regional or remote locations

If an event is cancelled, postponed or changed, the customer should contact us promptly. Cancellation or postponement of an event does not automatically create a right to cancel or return an order.

9. Custom Printing and Personalised Products

Custom printing is subject to artwork review, production capacity and written confirmation.

The customer is responsible for checking all details shown on an artwork proof, including:

  • Wording and spelling

  • Logos and symbols

  • Colours

  • Position and orientation

  • Quantity and candle style

Approval of an artwork proof authorises SafeFlame to begin production. Changes requested after approval may not be possible and may incur additional charges.

The customer warrants that they own, or have permission to use, all artwork, logos, names, trademarks and other material supplied to SafeFlame. The customer is responsible for claims arising from unauthorised use of supplied material.

Minor variations in print colour, position, density or appearance may occur within normal commercial printing tolerances. This does not affect rights relating to a material failure to match the approved proof.

Custom-printed and personalised products are subject to the exclusions and protections stated in our Return and Refund Policy.

10. Payment

Payment must be made using an accepted payment method shown at checkout or otherwise approved by SafeFlame.

Orders are not required to be dispatched or placed into custom production until the required payment, deposit or approved credit arrangement has been confirmed.

Approved account customers must pay invoices within the agreed credit period. Late or unpaid accounts may result in orders being held and future credit facilities being suspended or withdrawn.

Customers must not send payment-card details by email or through an unsecured communication method.

11. Shipping and Delivery

Customers must provide a complete and accurate delivery address, contact name, telephone number where requested and any relevant delivery instructions.

Additional costs caused by an incorrect or incomplete address, refused delivery or unsuccessful delivery attempt may be charged to the customer where permitted by law.

Delivery times are estimates and may be affected by carrier operations, weather, remote locations, peak periods and other circumstances outside our reasonable control.

Risk in the products passes to the customer upon delivery to the nominated address, except where applicable law provides otherwise.

12. Product Use and Safety

Customers must use products in accordance with supplied instructions and reasonable safety precautions.

Battery-operated products, batteries and small components should be kept away from young children except under appropriate adult supervision. Products must not be modified or used for an unintended purpose.

Event organisers are responsible for assessing their venue, audience and operational requirements and for supervising product distribution and use.

13. Returns, Refunds and Order Problems

Returns, cancellations, damaged products, incorrect products and refunds are managed under our Return and Refund Policy:

Nothing in these Terms of Service excludes or restricts any right or remedy that cannot lawfully be excluded.

14. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Products must be of acceptable quality, be fit for any purpose made known to us, match their description and comply with other applicable consumer guarantees.

Depending on the circumstances, customers may be entitled to a repair, replacement, refund or compensation where a product fails to meet a consumer guarantee.

Nothing in these terms excludes, restricts or modifies the Australian Consumer Law or any other right that cannot lawfully be excluded.

15. Intellectual Property

Unless otherwise stated, the SafeFlame name, branding, website content, product photographs, graphics, written material and other original content are owned by or licensed to Linfield Pacific Pty Ltd.

Website content may not be reproduced, republished, distributed or commercially used without prior written permission, except as permitted by law.

16. Third-Party Services and Links

The website may use or link to third-party services, including Shopify, payment providers, delivery carriers and external websites.

Third-party services are governed by their own terms and policies. SafeFlame is not responsible for third-party content or services beyond the extent required by law.

17. Limitation of Liability

To the maximum extent permitted by law, SafeFlame is not liable for indirect, incidental or consequential loss arising from use of the website or products.

This limitation does not apply where liability cannot lawfully be excluded or limited, including applicable rights and remedies under the Australian Consumer Law.

Nothing in these terms excludes liability for fraud, wilful misconduct, personal injury caused by negligence, or any other liability that cannot legally be excluded.

18. Privacy

Personal information is handled in accordance with our Privacy Policy.

Information may be provided to payment processors, delivery carriers and other service providers where reasonably required to process and fulfil an order.

19. Changes to These Terms

We may update these Terms of Service from time to time. The current version will be published on this website with its effective date.

An order is generally governed by the terms in effect when the order was placed, except where a change is required by law or subsequently agreed with the customer.

20. Governing Law

These Terms of Service are governed by the laws of New South Wales, Australia.

The parties submit to the courts and tribunals having jurisdiction in New South Wales, subject to any rights a customer may have under applicable consumer law.
